İnternet, birbirimize akıllarımızla dokunduğumuz ortak alanımız. 

 21. yüzyılın işbirlikçi, yenilikçi, hızla gelişen dünyasında Türkiye’nin insan temel hak ve özgürlüklerinin kullanımında adım adım geriye gitmekte olduğunu görmek biz İnsan Kaynakları Bloggerlarını şiddetle endişelendirmektedir.

Gerek Anayasamız, gerekse uluslararası normlara aykırı içeriğe sahip olan İnternet Yasası’na karşı tek nefes olup “Hayır” diyoruz. Ortak alanımıza devlet eliyle yapılacak insan hak ve özgürlüklerini kısıtlayıcı her türlü müdahaleye #karşıyız. 

İnterneti kullanma konusunda yeni nesillerin vizyonuna sahip olmak, birbirimize güvenmek, geleceğe dijital dünyanın faydalarına sarılarak özgür şekilde ilerlemek arzumuzun sonuna kadar arkasında duracağız.

Türkiye’de yeni internet yasası onaylandı ve yürürlüğe girdi. Yasa ifade özgürlüğü ve kişisel verilerin korunması bakımından hukuki sakıncalar içeriyor. Ayrıca internet ekosistemini olumsuz etkileyeceği dile getiriliyor. Getirilen düzenlemeler ise şöyle:

1. Bir internet sitesinde özel hayatın gizliliği ihlal edilirse, doğrudan 4 saat içinde erişim engelleme kararı verilebilecek. Bu kararı mahkemeden önce -devlete bağlı olarak çalışan bir idari kurum olan- Telekomünikasyon İletişim Başkanlığı (TİB) verecek ve ardından mahkemeye gidilerek bu karar kesinleştirilecek.

2. Özel hayatın ihlal olduğu gecikmesinde sakınca olan durumlarda, Kurum Başkanı erişim engelleme emri verebilecek. Bu karardan sonra mahkemeye gitmek gerekmeyecek. Yani Başkan emri ile site kapatılabilecek. Diğer yandan özel hayatın gizliliği ihlal edilen durumların ve acil durumların ne olduğu kanunda tanımlanmış değil. Ayrıca yayınlanmasında kamu yararı olan haller de kanunla korunmuş değil.

3. Bir internet sitesinde kişilik hakkı ihlalinde; artık uyar kaldır sistemine başvurmak gerekmeden, Mahkemeden 24 saatte erişim engelleme kararı alınabilecek. Hakim sitenin bir sayfasını ya da gerekli görürse tümünü kapatma yetkisine sahip. Kişilik hakkı ihlal edilenin cevap hakkı da kaldırıldı.

4. Kişilik hakkı ihlali sebebiyle bir site hakkında erişim engelleme kararı verildiğinde, önceden alınmış aynı kararla, yeniden mahkemeye başvurmadan, aynı mahiyetteki başka siteleri de kapattırmak mümkün. Bunun için Birlik yetkilendirildi.

5. Yeni yasa ile getirilen URL engelleme, sitenin sadece bir sayfasını engelleyeceği için olumlu gibi algılanıyor. Ancak bu sistem için kullanıcıların görüntülemek istediği tüm web adreslerinin bir süzgeçten geçmesi gerekir. Bu sistem hem interneti yavaşlatabilir, hem de kişilerin internetteki her hareketinin takip edilmesine sebebiyet verebilir.

6. Tüm erişim sağlayıcılar, kurulacak Erişim Sağlayıcıları Birliği’ne üye olmak zorundalar. Aksi halde faaliyet göstermek yasak. Ayrıca bu birlik üyesi erişim sağlayıcılar, gönderilen erişim engelleme kararlarını uygulamak zorunda. TİB tarafından talep edilen tüm bilgi, belge ve kayıtları da  teslim etmekle yükümlüler. Aksi halde ceza uygulanacak.

7. Birlik üyesi tüm erişim sağlayıcılar, URL bazlı engelleme ve alternatif erişim yöntemlerini engellemek için gerekli altyapıyı kurmak zorunda. Yani DNS değiştirmek ve VPN kullanmak da işe yaramayabilir. Ayrıca kanunen masrafı kendilerine ait olmak zorunda, bu altyapılar oldukça pahalıdır ve kullanıcılara yansıyacaktır.

8. Yer sağlayıcılar için getirilen düzenlemeyle, trafik bilgisini saklama zorunluluğu artık 6 ay değil. Minimum 1 yıldan 2 yıla kadar uzatıldı. Eskiden bu verileri sadece belli bir soruşturmaya ilişkin olarak mahkeme talep edebilirdi. Yeni yasa ile TİB talep ettiğinde, yer sağlayıcı bu verileri tümden teslim etmekle yükümlü.

Bu yasa Türkiye’de şuan onaylandı ve yürürlüğe girdi. Ancak sakıncalar tepki topladı ve hükümet yeniden teklif sundu. İkinci teklif henüz yasalaşmadı. Bu sefer de ‘mahkeme kararı olmadan TİB verileri isteyemeyecek, ancak siber güvenlik riski varsa bu verileri talep edebilir’ şeklinde bir madde görüşülüyor. Fakat ikinci teklif de sakıncaları gidermiyor. Çünkü bakış açısına göre internetteki her ihlal siber güvenlik tehdidi kapsamında sayılabilir.

Kaldı ki bu yasanın tümüyle iptali gerekir çünkü ifade özgürlüğüne ve kişisel verilerin gizliliğine aykırıdır. Ayrıca kişilerin haber alma özgürlüğüne ve bilgiye erişme hakkına da devlet eliyle kısıtlama getirmektedir. Tüm bu haklar temel hak ve özgürlüklerdendir ve kısıtlanması hem Anayasa’ya Avrupa İnsan Hakları Sözleşmesi’ne de aykırıdır.

Watching Turkey gradually go back in terms of fundamental rights and liberties in 21st century’s collaborative, innovative and rapidly developing World has been a matter of severe concern for Human Resources Bloggers.

With full unity, we say “No” to Internet Regulation complying with neither Turkish constitution nor international norms. We are against all kinds of government favored interventions aimed at our common area and limiting human rights and liberties.

We will abide, to the fullest extent, by our desire to adopt the vision as to internet usage internalized by new generations, to trust each other and to proceed to the future with freedom by clinging to benefits of digital world.

WHY ARE WE AGAINST REGULATION?

The new Internet bill has been approved and come into force. In terms of freedom of speech and data protection, the new law comprises some legal inconvenience. Besides, it has been emphasised that the new law will affect the internet  ecosystem in a negative fashion. The amendment of the new legislation is as follows:

1. Once the privacy of an individual is violated on a site, the access to that site will be cut off directly within 4 hours. This decision will be given by the Telecommunication Directorate (TIB), which is a state institution, prior to a court order and this decision will be solidified by a court order after taking the action.

2. In the cases of disability of delay on an individual’s privacy violation, the director will be able to order for blocking. There will be no need to take the case to the court after this decision. In other words a web site will be blocked by the director. On the other hand, neither what the situations that violate the privacy, nor what the emergency situations are have been clearly defined. Yet, the cases which are for common good to be published are not protected by law.

3. If a website violates an individual’s privacy, without any application to ‘notice and take down system’, a court order will be given within 24 hours to block the access. The judge has the authority to partially block or if necessary, entirely block a web page. The right of reply of the person whose rights have been violated has also been abolished.

4. Once the decision is made to block the access to a web site due to violation of personel rights, it is possible to have other web sites that have the similar content blocked without any court order. The directorate has been authorised to do this.

5. The URL blockage, which has been brought by the new legislation, is also being misinterpreted since it only blocks only a single page. However, for this system, all the URLs that the users would like to view should be filtered. This system might both slow the internet speed down and result in monitoring the individuals’ activities on the Net.

6. All Internet service providers (ISPs) are now obliged to be the members of the Union of Service Providers which will be established soon. Also, the member providers will have to enforce the orders sent by the Union. They are also responsible of supplying any necessary information, documentation and records that can be demanded by TIB. Failure in doing so will lead to them being penalised.

7. All member ISPs are obliged to form a necessary infrastructure for URL-based blocking and blocking of alternative access methods. This means that changing DNS or using a VPN might not work. Also, by law, ISPs are responsible for the costs of these systems. Since the infrastructure is pricy, it will eventually affect the end users.

8. With the new  legislation for hosting providers, the obligation to store the Internet traffic is no longer 6 months. It has been extended to minimum 1 year to 2 years. In the past, only the judiciary had the right to demand the data for certain investigations. With the new law, anytime TIB asks for it, the hosting provider is obliged to hand it in.

This legislation has just been approved and come into force in Turkey. However the inconvenience has attracted the public attention and the government has proposed a new bill. The second bill has not become law. This time the article ‘without any court ruling TIB cannot ask for the data, however this in not the case if there is a cyber risk’ is being discussed. The second proposal does not bring a solution to the inconvenience. With this viewpoint any violation can be counted as a cyber security threat.

Besides, the repeal of this legislation is vital since it is against freedom of speech and privacy of personal data. Furthermore, it brings restriction to people’s freedom of information and their right to reach information. All these rights are among basic rights and freedom; restriction of these rights are against the Turkish Constitution and European Convention of Human Rights.
